Texas prescribes 4 statutory lien waiver forms (Texas Property Code sections 53.281 to 53.287, forms in section 53.284). This page lists each one, when a subcontractor signs it, what the statute requires on the page and the blanks it has, with a form that fills the statutory text with your figures and downloads the PDF.
The forms the statute prescribes
Conditional Waiver and Release on Progress Payment (Property Code section 53.284(b)). Send it with the pay app. It takes effect when the named check is endorsed and paid by the bank.
Unconditional Waiver and Release on Progress Payment (Property Code section 53.284(c)). Sign it once the progress payment has cleared. The form states that you have been paid.
Conditional Waiver and Release on Final Payment (Property Code section 53.284(d)). Send it with the final pay app. It takes effect when the final check is paid.
Unconditional Waiver and Release on Final Payment (Property Code section 53.284(e)). Sign it after the final payment has cleared. It states that you have been paid in full.
What Texas Property Code sections 53.281 to 53.287, forms in section 53.284 requires
A waiver is enforceable only if it substantially complies with a section 53.284 form and is signed by the claimant or an authorized agent; a conditional waiver also needs evidence of payment (section 53.281).
Notarization is no longer required. The requirement left the statute with H.B. 2237 on January 1, 2022.
Nobody may require an unconditional waiver until the claimant has been paid that amount in good and sufficient funds (section 53.283).
The two unconditional forms open with a bold notice at least as large as the largest type on the document and no smaller than 10 point.
A progress waiver releases what the attached pay application or statement bills, except unpaid retention, pending changes and other items furnished.
