Georgia prescribes 2 statutory lien waiver forms (Official Code of Georgia Annotated section 44-14-366). The forms the statute prescribes
Waiver and Release of Lien and Payment Bond Rights upon Interim Payment (O.C.G.A. 44-14-366(d)). Send it with each progress pay app. It releases work through the date you enter and keeps retainage.
Waiver and Release of Lien and Payment Bond Rights upon Final Payment (O.C.G.A. 44-14-366(e)). Send it with the final pay app.
What Official Code of Georgia Annotated section 44-14-366 requires
Two forms: interim payment (subsection d) and final payment (subsection e). Each must be in at least 12 point type; capitals and bold are no longer required.
The waiver binds the claimant on the earliest of actual payment, a separate written acknowledgment of payment, or 90 days after signing, unless an affidavit of nonpayment is filed inside those 90 days (subsection g).
Because of the 90 day rule there is no separate unconditional form. This tool prints each form as a conditional waiver.
A blank left empty does not invalidate the form as long as the subject of the release can reasonably be determined.
