California prescribes 4 statutory lien waiver forms (California Civil Code sections 8120 to 8138). This page lists each one, when a subcontractor signs it, what the statute requires on the page and the blanks it has, with a form that fills the statutory text with your figures and downloads the PDF.

The forms the statute prescribes

Conditional Waiver and Release on Progress Payment (Civil Code section 8132). Send it with the pay app, before the check arrives. It releases work through the through date once the named check is paid.

Unconditional Waiver and Release on Progress Payment (Civil Code section 8134). Sign it after the progress payment has cleared. It takes effect on signature whether or not you were paid, which is why the statute puts a notice on it.

Conditional Waiver and Release on Final Payment (Civil Code section 8136). Send it with the final pay app. It releases everything but disputed extras once the final check is paid.

Unconditional Waiver and Release on Final Payment (Civil Code section 8138). Sign it after the final payment has cleared. It states that you have been paid in full.

What California Civil Code sections 8120 to 8138 requires

A waiver releases the owner, lender or surety only if it is in substantially the statutory form and signed by the claimant (section 8124). Any other statement purporting to waive a lien is void (section 8126).

A conditional waiver takes effect when the check it names is paid. The form tells the recipient to look for evidence of payment before relying on it.

The two unconditional forms carry a Notice to Claimant in type at least as large as the largest type on the form (sections 8134 and 8138).

Change orders fully signed before the waiver date are released unless listed as an exception. Retentions and unpaid extras are never released by a progress waiver.

The blanks each form has
